INTRODUCTION MOVIOLA provides a full rural cinema service across five counties in the South / South West of England. The extensive nature of the scheme and the large number of films shown means that we are able to establish special relationships with national film distributors, including access to films ahead of their standard DVD release. We do not ‘own’ films. They are supplied to us by the London distributors. Associate Moviola membership allows community-based venues across the United Kingdom to share in our ‘block booking’ and benefit from having no minimum hire charges and no VAT on film hire charges because our organisation can reclaim all VAT. Associate Moviola venues are sent a Menu of recommended films and a DVD of trailers three times a year: in June for the September to December season, in November for January to Easter, and in March for Easter to the end of August. This allows participants to choose from the very latest film releases. Associate Moviola members can also request free of charge a support disk for each feature film containing either a short film and trailers of forthcoming films or just trailers. From September 2009, some titles will also be available on Blu-Ray High Definition format as well as standard DVD and members will be able to request appropriate format. From September 2009, Filmbank – the UK’s main provider of films for the community cinema sector - will allow venues to use their own DVDs and Blu-Ray disks provided these are generally available to the public. In the light of this, we are offering two levels of service: GOLD and SILVER in order that you can economise on the costs of film hire. Please read through carefully both sets of Conditions to select the one best suited to you. In summary: GOLD – we provide everything for you. SILVER - we handle for you the booking (licensing) and all other contacts with distributors but you provide your own disks. Moviola is a Charitable organisation dedicated to improving access to cinema for community groups, especially those in rural areas. The information which follows sets out in necessary detail the way that our Associates scheme works. We also provide Associates with any advice and help they need to show films successfully. CONDITIONS OF SERVICE –PLEASE READ CAREFULLY THE GOLD SERVICE 1. For films which are being shown across the Moviola and Associates network, you will be charged 35% of your gross box office, with no minimum charges or VAT on film hire. You will be informed at the point of booking if the charging level is likely to be other than this. 2. We can book for you any film which is not on the menu but if you are the only venue showing this title, you will be responsible for the normal distributor’s guarantee (e.g. Filmbank £93) or 35% of box office whichever is the larger. 3. You agree to pay Moviola an administration fee of £40 + VAT (total £48) for each film you book through the scheme. 4. We will send you a confirmation of your films which will include the charging level for each title. 5. Disks will be mailed to you by Post Office Special Delivery from Moviola in Yetminster at a current cost of £5.50 for postage only. You will refund this postage to Moviola. Disks will arrive at latest the day before your show. 6. You will return disks to Yetminster (or other address as instructed) the day after your show. You agree to pay the postage for this leg of the operation. You undertake to be punctual in returning disks and if you are late in returning disks, you understand that you may be responsible for costs arising from the cancellation of another user’s show. 7. While the disk is in your care, you will guarantee its security and undertake not to copy it or loan it to a third party. You will handle the disk with care during projection and let Moviola know immediately if there is any problem with the disk. 8. Within seven days of your show date, you will post or email the Moviola return form stating number of tickets sold and at what price. This is an official auditable return. You will maintain and keep evidence of ticket sales (e.g. ticket stubs, ticket books) for 12 months from the date of show and agree to make these available for audit by Moviola or the Film Distributor. 9. On the basis of the return form, Moviola will invoice you for costs associated with the show (film hire, postage, admin fee). You agree to pay this invoice within 28 days of receipt by cheque or BACS transfer. 10. Where supporting programmes are being prepared by Moviola to accompany specific films, these will be available to you at no extra cost. The supporting programme disk will contain approx 20 minutes of short films and/or trailers for your forthcoming films. Support disks remain the property of Moviola and must be returned after use. 11. We will accept a cancellation of a booking without charge up to SEVEN days before your show. After that, you agree to pay any administration charges associated with the booking (including postage and Moviola fee). 12. Films are booked for you by Moviola from the relevant Film Distributors. Your show is licensed to you by the Film Distributor through Moviola. Contact Moviola (not the Film Distributor) if you have any query about your booking or if anyone asks for proof that your show is licensed. Your show must comply with the standard conditions applicable to public film shows (for example adherence to BBFC classifications U, PG, 12A etc). It is your responsibility to ensure that your screening venue is licensed with the local authority for public film showing.
THE SILVER SERVICE 1. For films which are being shown across the Moviola and Associates network, you will be charged 35% of your gross box office with no minimum charges or VAT on film hire. You will be informed at the point of booking if the charging level is likely to be other than this. 2. We can book for you any film which is not on the films menu but if you are the only venue showing this title, you will be responsible for the normal distributor’s guarantee (e.g. Filmbank £93) or 35% of box office whichever is the larger. 3. You agree to pay Moviola an administration fee of £25 + VAT (total £30.00) for each film you book through the scheme. 4. We will send you a confirmation of your films which will include the charging level for each title. 5. You are permitted to use your own feature film disk for your show. Please note that this must be a film owned by you. You are NOT allowed to use disks hired from a video rental outlet such as Blockbuster or any on-line rental service. Please note that any ‘extras’ on your DVD are NOT licensed for showing to the public. Only the feature film itself may be shown. 6. You will receive a Return Form from Moviola by email (or if necessary post) and you will return this within seven days of your show date. This will state the number of tickets sold and at what price. This is an official auditable return. Emergency Default Service: In the event of a film not being available locally, Moviola will supply the disk to you and default for that title only to the Gold Service. Equally, if you find at the last minute that your disk is not available locally, you can contact Moviola and we will do our best to supply the disk – again on the basis of the Gold Service. Such alterations to your normal conditions of service will be notified to you in advance of your show.
JOINING THE SCHEME Associate Moviola venues will be required to complete a Registration Form confirming the service they wish to join and the detailed ‘extras’ of the scheme that they require. The form will require the postal address and contact details of the organisation and a signature from an authorised representative. Signing the form signifies agreement to the conditions set out above. Associate Moviola venues are listed on the UK Associates page of this website and we are happy to put there any information you want, for example contact details for your venue, how to buy tickets, a link to your own website. Moviola is a Registered Charity and our constitution restricts us to providing the above service to not-for-profit organisations such as village halls, arts centres, and other Charitable bodies. We regret that this service is not available to private profit making organisations or ones established for a purely commercial purpose.
